This Privacy Policy explains how we use and protect the personal data that you provide to us, or that is otherwise collected or generated by us, when you use our mobile application (the “App”) and services (the “Services”). For the purposes of this Privacy Policy, “we”, “us”, and “our” refer to Wimit, and “you” refers to you as a user of the App and Services.

This Privacy Policy does not apply to the third-party stores from which you install the App or make payments, which may also collect and use data about you. We are not responsible for any of the data collected by any such third party.

Information We Collect

The information we collect via the App depends on how you use it and includes:

Personal Data You Provide

Personal data you provide when creating an account and by using the App. In order to use certain features, such as being able to find nearby places, or receive notifications, we will request your permission which you can revoke at any time.

Basic Account Data

To create your account, you provide your mobile phone number and basic account data which includes a name and may include a picture and email. Your mobile phone number, and email if you have provided one, are not shared publicly with anyone, not even your contacts. Your name, and picture if you have provided one, are only shared with the people that you or your contacts have invited to meet via the App in order to make it easier for them to recognise who you are.

Contacts

You provide us, all in accordance with applicable laws, the phone numbers in your mobile address book on a regular basis, including those of both the users of our Services and your other contacts, and may also provide us names and email addresses. We ask your permission before syncing your contacts, and store your up-to-date contacts in order to notify you as soon as one of your contacts signs up for Wimit and to properly display names in notifications.

Calendar

In order to add confirmed invites to your calendar, keep their details (names of people attending, place, date, and time) up-to-date, as well as suggest appropriate dates and times based on your availability, we request permission to access the calendar of your mobile device. If you wish to change this permission at any time you may do so in your device’s settings.

Chat Messages

Chat messages that you send are delivered to all of the participants of an invite and stored both in the cloud and the participant’s devices. All messages are encrypted in transit and are accessible by all of the invite’s participants even if they have been added to the invite at a later time by you or another participant.

Geo-Location

In order to provide location-based services, such as finding nearby places or when you choose to share your location with the people you have arranged to meet, we request permission to access the location of your mobile device while you are using the App. If you wish to change this permission at any time you may do so in your device’s settings. If you choose not to allow access to the location of your mobile device we cannot guarantee that the App will work as expected.

Push Notifications

In order to notify you about new invites, updates to invites, and chat messages we request permission to send you push notifications. If you wish to opt-out from receiving these types of communications, you may turn push notifications off in your device’s settings.

Customer Support

You may provide us with information related to your use of our Services, including screenshots of the App in use, and how to contact you so we can provide you customer support. For example, you may send us an email with information relating to the performance of the App or other issues.

Automatically Collected Data

Information our servers automatically collect when you access our Services.

Cookies

The only cookies we use are those to operate and provide our Services on the web. The cookies we use are small text files that allow us to operate, analyse, improve, market, and customise our Services, and in doing so provide you with an enhanced user experience, for example by remembering your language preferences. Your browser should allow you to control these cookies, including whether or not to accept them and how to remove them. You may choose to block our cookies with your web browser, however, if you do disable these cookies Wimit might not work as expected.

Website Analytics

We may also use third-party providers, such as Google Analytics, to analyse and track the use of our website through the use of third-party cookies. By accessing our website, you consent to the collection and use of your information by these third-party providers. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer personal information to these third-party providers. However, if you do not want any information to be collected and used by tracking technologies, you can install and/or update your browser settings using the Google Analytics Opt-Out Plugin.

App Usage and Log Data

We collect information derived from your activity on our Services, such as crash reports and performance related information. This includes information about when you registered to use our Services, when you last used our Services, as well as the frequency and duration of your activities and interactions. We also collect diagnostic, crash, and performance logs and reports.

Device Data

We collect device information when you install and use the App in order to diagnose and resolve issues that may affect the App’s performance. Device information includes your mobile device model, manufacturer, operating system version, battery level, memory capacity, locale, timezone, and version of the App installed.

Third Party Services

We work with third-party service providers to help us operate, provide, improve, understand, customise, support, and market our Services. For example, we work with companies to distribute our App, host our infrastructure, deliver messages and notifications, supply location, map, and places information, process payments, help us understand how people use our Services, market our Services, conduct surveys and research, and help with customer support. These companies may provide us information about you in certain circumstances; for example, app stores may provide us reports to help us diagnose and resolve issues.

Payment Information

When subscribing, you use the payment details that you have provided to the respective app store which will be processing the payment. This information is stored by the app store and your credit card information never reaches our servers. We do not access nor store your credit card information. When the payment for your subscription is being processed by the respective app store, the app store only sends Wimit information about whether the payment was successful or not and a token used to verify whether the subscription has expired.

We process your personal data as described above:

  1. as necessary to further our legitimate interests, unless those interests are overridden by your interests or fundamental rights and freedoms that require protection of personal data
  2. as necessary to comply with our legal obligations
  3. consistent with your consent, which you can revoke at any time

Processing Your Personal Data

We will process your personal data as described above in order to suggest nearby places, deliver any invites you sent, notify the people that you have invited, notify you of any invites and chat messages received, notify you of any updates to the invites you participate, suggest possible dates and times based on your availability, keep any confirmed invites in your calendar up-to-date, provide customer support, improve our Services, and diagnose any technical issues.

Protecting Your Personal Data

We use appropriate security measures to protect the security of your personal data both online and offline. These measures vary based on the sensitivity of the personal information we collect, process and store, and the current state of technology. We also take measures to ensure third-party service providers that process personal data on our behalf also have appropriate security controls in place.

Please note that no service is completely secure. While we strive to protect your data, we cannot guarantee that unauthorised access, data loss or a data breach will never occur.

Storing Data

If you signed up to use Wimit from the UK or the EU, your data is stored in third-party provided data centres within the EU. However, chat messages may be stored by third-party service providers in the US which participate in the EU-US Privacy Shield framework.

Data Retention

The personal data that you provide us will be stored until it is no longer necessary to provide our Services, or until your account is deleted.

Sharing Your Personal Data

Information shared between you and other users, and information we may share with third-party service providers and law enforcement authorities.

With Other Users

You share data with other users when sending an invite or adding people to an invite. Your name, and picture if you have provided one, along with the name and picture of the people invited by you or others is shared amongst all the invite’s participants in order to make it easier for everyone to recognise each other.

With Third-Party Service Providers

We may share your information with third parties that perform services for us or on our behalf, including data analysis, email delivery, hosting services, marketing, and customer service. We take measures to ensure third-party service providers that process personal data on our behalf also have appropriate security controls in place.

With Law Enforcement Authorities

We may share information with the law enforcement authorities, as permitted or required by any applicable law, rule, or regulation, if it is reasonably necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others.

Managing and Deleting Your Personal Data

Under the General Data Protection Regulation (the “GDPR”) you have particular rights available to you depending on which legal basis we use to process your personal data. You should know that no matter what legal basis applies, you always have the following rights.

  1. request a copy of all your personal data that we store
  2. transfer a copy of your personal data to another service
  3. delete or amend your personal data
  4. restrict, or object to, the processing of your personal data
  5. correct any inaccurate or incomplete personal data we hold on you
  6. lodge a complaint with national data protection authorities regarding our processing of your personal data

Changes to Our Privacy Policy

We will notify you at least 30 days before we make substantial changes to this Privacy Policy and give you the opportunity to review the revised Privacy Policy before you choose to continue using our Services.

Please note that we may not be able to provide such notice for changes that are required to address security or technical issues with our Services or for changes made for legal reasons, which will become effective immediately.

Your continued use of our Services following the notice period of planned changes confirms your acceptance of our Privacy Policy as amended. We hope you will continue using Wimit, but if you do not agree to our Privacy Policy, as amended, you must stop using our Services by deleting your account.

Assignment, Change of Control, and Transfer

All of our rights and obligations under this Privacy Policy are freely assignable by us to any of our affiliates, in connection with a merger, acquisition, restructuring, or sale of assets, or by operation of law or otherwise, and we may transfer your information to any of our affiliates, successor entities, or new owner. In such a case, we cannot guarantee that your rights and our obligations will be governed by the exact same Privacy Policy, but we will try to ensure that the same principles apply.
